OWI / Restricted Controlled Substance / Ignition Interlock / OAR / Obstructing – Columbia County (September 2026)
Result: All Charges Dismissed After Defense Challenges Warrantless Entry
Handled By: Attorney Corey Chirafisi
Summary: The client faced multiple charges, including OWI, Operating with a Restricted Controlled Substance, an ignition interlock violation, Operating After Revocation, and Obstructing. Police initially followed the client from a bar and attempted to stop him for speeding. After reaching his residence, the client ran from officers and entered his home. Police pursued him inside without first obtaining a warrant. Attorney Chirafisi had already successfully obtained suppression of the client’s statements based on a Miranda violation and then identified an additional constitutional problem with the officers’ warrantless entry into the residence. Rather than file another suppression motion, the defense presented the controlling law directly to the prosecutor. The prosecutor agreed with the defense’s analysis and dismissed every charge against the client.
