OWI Second Offense – Dane County (September 2026)

Result: Case Dismissed After Court Finds Detention Unsupported by Reasonable Suspicion

Handled By: Attorney David K. Anderson

Summary: The client arrived at the scene of a traffic stop to retrieve property belonging to his girlfriend. Law enforcement remembered that the client had been out with her earlier and learned that he had consumed alcohol. Based on that information, officers detained him, required him to perform field sobriety tests, and ultimately arrested him for Second-Offense OWI. Attorney Anderson challenged the legality of the detention, arguing that the mere fact that a person has consumed alcohol does not, by itself, create reasonable suspicion that the person is operating while impaired or above the legal alcohol concentration. The Court agreed that law enforcement lacked the required reasonable suspicion to detain the client in the first place. As a result, the OWI case was dismissed.
