Summary: The client faced an extremely serious charge of Repeated Sexual Assault of a Child based on allegations that he had sexually assaulted his then-girlfriend’s 12-year-old daughter on multiple occasions. After the case remained pending for nearly four years, Attorney Covey conducted an extensive investigation into significant weaknesses in the State’s evidence. The defense identified problems with the DNA evidence and favorable findings from a SANE examination conducted approximately 48 hours after the alleged assault. The defense also investigated reports that the alleged victim had made multiple statements contradicting or recanting her accusations, retaining a private investigator who successfully located several witnesses and obtained highly favorable statements. A critical development came through the defense’s investigation of the alleged victim’s related CHIPS proceedings, where additional exculpatory statements made to the guardian ad litem were uncovered. Following the development of this evidence, the State moved to dismiss the case, bringing the nearly four-year prosecution to an end.
